Chemerinsky: Supreme Court’s terrible reasons allowing Texas’ racially rigged map
16+ min ago (239+ words) At the urging of President Trump, Texas" Republican-controlled state Legislature redrew congressional districts to help Republicans retain control of the U.S. House of Representatives. Gov. Greg Abbott signed this into law on Oct. 25. It was immediately challenged in court. But the Supreme Court nonetheless overturned the district court"s decision and will allow Texas to use its new districts. The court gave three reasons. One of the most basic principles in jurisprudence is that appellate courts are to accept the fact finding by lower courts unless it is clearly erroneous. The Supreme Court disregarded this and gave no deference to the detailed facts found by the federal district court. Abbott did not sign the bill for the new districts until late October. The plaintiffs sued immediately. The district court acted as expeditiously as possible and issued its ruling on Nov. 18. This…...

Judge orders Trump to end California National Guard troop deployment in Los Angeles
47+ min ago (206+ words) By SUDHIN THANAWALA, Associated Press The Trump administration must stop deploying the California National Guard in Los Angeles and return control of the troops to the state, a federal judge ruled Wednesday. U.S. District Judge Charles Breyer in San Francisco granted a preliminary injunction sought by California officials who opposed President Donald Trump's extraordinary move to use state Guard troops without the governor's approval to further his immigration enforcement efforts. But he also put the decision on hold until Monday. California argued that conditions in Los Angeles had changed since Trump first took command of the troops and deployed them in June. The administration initially called up more than 4,000 California National Guard troops, but that number had dropped to several hundred by late October, with only a 100 or so troops remaining in the Los Angeles area. But the Republican administration extended…...

Lawsuit challenges California’s ban on less-lethal pepperball weapons
1+ hour, 35+ min ago (544+ words) A newly filed lawsuit in San Diego federal court is challenging the constitutionality of California laws that prohibit state residents from buying and owning weapons that fire pepper projectiles, arguing that banning the less-lethal weapons violates the Second Amendment. Such weapons are known as pepper projectile launchers and typically resemble a pistol or rifle, using CO" cartridges to fire pepperballs, which are about the size of paintballs and are filled with a chemical irritant powder designed to temporarily incapacitate the person being shot. "Pepper projectile launchers are a commonly-used arm that many Americans choose as a non-lethal alternative to firearms," the lawsuit argues. "California doesn't just deny its citizens this choice; it criminalizes the act of selling or possessing such an arm. This inexplicable ban violates the Second Amendment." The lawsuit argues that a unanimous U.S. Supreme Court decision from 2016 held…...

And for miles around that spot, motorists endured a massive, extended transportation nightmare that slowed travel around the region. Social media posts captured some of the pain. For some, nature called and there was no way to answer. Someone wrote on X that they saw a guy get out of his car to urinate on the highway. San Diego police acknowledged the trouble the incident caused for motorists but said their main goal is "to ensure the safety of everyone involved, including someone who may be looking to harm themselves." If a similar situation occurred again, officials said they'd respond the same way. "This…...
